These Terms of Service (“Terms”) govern your access to webasto.co and services provided by Webasto Cyber Security B.V. (“Webasto,” “we,” “us”), including domain security monitoring, phishing and impersonation intelligence, and related takedown coordination as described in your order form or service description. By creating an account, purchasing a subscription, or using our APIs or portals, you agree to these Terms.

1. Service description and reliance

Webasto aggregates signals from DNS, certificates, hosting footprints, and partner feeds to highlight domain-based risks. Outputs may include alerts, dashboards, and recommended actions. Automated detections can produce false positives or miss novel threats. You remain responsible for validating alerts, coordinating with legal counsel, and deciding whether to initiate takedowns or blocklists.

2. Accounts and security

You will provide accurate corporate information, maintain strong credentials, restrict access to authorized personnel, and promptly notify us of suspected compromise. You are liable for activity conducted through your accounts unless you demonstrate unauthorized access despite reasonable safeguards.

3. Acceptable use

You may not use Webasto services to stalk individuals, harass unrelated third parties, conduct unauthorized surveillance, violate sanctions, scrape our platform beyond permitted API limits, reverse engineer our software except where mandatory law allows, or probe our infrastructure. You may not resell access except as expressly permitted in an enterprise agreement.

4. Customer data and instructions

You grant Webasto a license to process domains, brands, and technical indicators you submit solely to deliver the services. You represent that you have rights to monitor the assets you list and that your instructions comply with law. We may refuse actions that appear abusive or legally impermissible.

5. Third parties and takedowns

Takedown outcomes depend on registrars, hosts, courts, and law enforcement. Webasto does not control third-party timelines or decisions. Fees for professional services may apply even if a provider declines action.

6. Intellectual property

Webasto retains all rights in software, models, documentation, and branding. You receive a non-exclusive, non-transferable license to use the platform during your subscription. Feedback you provide may be used to improve services without obligation to you.

7. Warranties and disclaimer

Except as stated in a written SLA, services are provided “as is.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent permitted by Dutch and applicable law.

8. Limitation of liability

To the maximum extent permitted by law, Webasto’s aggregate liability per contract year is limited to the fees you paid for the affected service tier, excluding VAT. We are not liable for indirect, consequential, or punitive damages, or for lost revenue, except where mandatory law prohibits such exclusion (for example intent or gross negligence).

9. Indemnity

You will indemnify Webasto against claims arising from your misuse of the services, unlawful takedown requests, or allegations that data you supplied infringes third-party rights.

10. Suspension and termination

We may suspend access for non-payment, security incidents, or credible abuse. Either party may terminate per the subscription terms; provisions that reasonably should survive (confidentiality, liability limits, indemnity) will continue.

11. Privacy and cookies

Processing of personal data is described in our Privacy Policy, GDPR page, and Cookie Policy.

12. Governing law and venue

These Terms are governed by the laws of the Netherlands. Courts in Rotterdam have exclusive jurisdiction for business customers, subject to mandatory consumer protections.

13. Changes

We may update these Terms with notice where required. Continued use after updates may constitute acceptance.
